3. User Accounts and Registration

To use RecoverCart, you must:

• Have a valid Shopify store
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be at least 18 years old or have parental consent

4. Acceptable Use Policy

You agree not to use the App to:

• Send spam, unsolicited, or inappropriate messages
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to our systems

5. WhatsApp Business API Compliance

Our app integrates with WhatsApp Business API. You agree to:

• Comply with WhatsApp's Business Policy and Terms of Service
• Only send messages to customers who have opted in
• Respect customer preferences for message frequency
• Include opt-out instructions in messages when required
• Not use the service for spam or unsolicited communications
• Maintain accurate customer contact information

6. Payment Terms

RecoverCart operates on a subscription basis. Payment terms include:

• Subscription fees are billed in advance
• All fees are non-refundable except as required by law
• We may change pricing with 30 days notice
• Failure to pay may result in service suspension
• Taxes are your responsibility where applicable

7. Intellectual Property

The App and its original content, features, and functionality are owned by RecoverCart and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices regarding the collection and use of your information.

9. Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. The App may be temporarily unavailable due to:

• Force majeure events

10. Limitation of Liability

12. Indemnification

You agree to indemnify and hold harmless RecoverCart from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RecoverCart operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on our website and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.
